New Procedure for Holds Inspection

By Resolution RESOL-2020-861-APN-PRES#SENASA, the National Health and Agrifood Quality Service [SENASA by its Spanish acronym] adds to Resolution No 693/17 the “Supervision procedure of the Control System of Capability of Loading of Holds and Tanks of Vessels and Barges for the export of grains, their products and by-products” and the “Selection of Vessels Procedure.”

This new resolution establishes that the required entity shall perform the verification in situ of the compliance of its requirements, with the exclusive intervention of verifiers authorized by SENASA and, when appropriate, certify the ability of holds/tanks. In order to comply with this obligation, the certifying entities shall perform an Inspection Report with photographs, video films and any other record, in any type of technological support where the supervised facilities shall be observed and registered.  This documentary evidence shall be mentioned in the report and available when the enforcement authority requests it. Images and films must clearly show the facilities inspected, their proportions and features.

The National Operations Agency of SENASA is the enforcement authority of the Control System of Capability of Loading of Holds and Tanks of Vessels and Barges for the export of grains, their products and by-products. In exercise of such authority, it is in charge of interpreting the scope and application of this resolution, appointing, organizing and directing the acting personnel who perform the aforementioned control system, verifying its fulfillment, supervising the authorizations carried out according to the procedure determined by this resolution, controlling the certifying entities and executing any other activity that shall improve the system.

This new resolution shall become in force as from November 20th, 2020.

We consider it is important to highlight that the Centro de Navegación is in contact with SENASA so as to control and make observations on the stipulated procedure. In this sense, the supervisions carried on by the inspectors shall depend on the National Operations Agency of SENASA (Section 7 Resolution 693/17) so that the decisions rejecting the hold that prevent loading operations of the vessel are taken after consulting the aforementioned Agency with the aim of reducing presumed deviations of procedures or arbitrariness towards the user.
